唯冠訴蘋果侵權案上海開庭 iPad或遭禁售大綱

The Pudong New District People's Court held a hearing Wednesday after Proview Technology (Shenzhen) asked the court to immediately ban the sale of the iPad.
本週三，唯冠科技（深圳）有限公司起訴蘋果商標侵權案在上海浦東新區人民法院開庭，唯冠科技要求法院立即禁止蘋果iPad的銷售。

The debt-laden Proview Technology (Shenzhen) has claimed that it owns the right to use the iPad trademark on the Chinese mainland and that Apple's product infringes on its trademark.
傳聞目前負債數十億的唯冠科技聲稱該公司擁有在中國大陸地區使用iPad商標的權利，蘋果公司的產品造成了商標侵權。

Apple Trading (Shanghai) Co., Ltd., which runs three Apple retail stores in Shanghai, asked the court to reject Proview's request pending a final verdict on the ownership of the trademark in China.
蘋果貿易（上海）有限公司在上海擁有三家專賣店，則要求法院拒絕唯冠的訴求，目前該商標在中國的使用權存在很大爭議，蘋果方面表示沒有最終裁決之前，應該中止這個案件的審理。

The Shanghai court will hand its verdict down at a later date.
上海浦東新區人民法院未當庭作出結論，表示將在近日作出書面答覆。

Proview Technology (Shenzhen) and US technology giant Apple have been tangled in a lengthy dispute over the right to use the iPad trademark in China.
唯冠科技（深圳）有限公司與美國科技巨頭蘋果公司，就iPad商標在中國的使用權糾紛已經陷入了長期的訴訟拉鋸戰。

Proview Taipei registered the iPad trademark in a number of countries and regions as early as 2000, with Proview Shenzhen registering the trademark on the Chinese mainland in 2001.
唯冠（臺灣）公司早在2000年就已經在多個國家和地區註冊了iPad商標，唯冠（深圳）公司於2001年在中國大陸註冊了該商標。Apple bought the right to use the trademark from Proview Taipei in February 2010 via IP Application Development Limited (IP), a company based in the US. However, Proview Shenzhen claims it still reserves the right to use the trademark on the Chinese mainland.
2010年2月，蘋果公司通過在英國註冊的IP Application Development Limited公司（縮寫iPadL）買入了iPad商標的使用權。但唯冠（深圳）公司聲稱該公司仍然保留在中國大陸的商標使用權。雙方自此就陷入了商標侵權的訴訟混戰中。

Apple said last week that it bought Proview's worldwide rights to the iPad trademark in 10 different countries several years ago. Apple added that a Hong Kong court backed the company, as Proview refused to honor their agreement.
蘋果公司上週也打破過往的沉默，就該案發表了一份簡短聲明，稱該公司在幾年前就買下了iPad商標在全球範圍了10個國家的使用權，指責唯冠拒絕履行協議，並稱香港法院已支持蘋果。

Although a final verdict in the mainland has yet to be delivered, authorities in some Chinese cities have taken action to seize iPads after receiving complaints from Proview Shenzhen. The move has also prompted Apple retailers in many Chinese cities to pull iPads off their shelves.
雖然此案在中國大陸地區的最終裁決還沒發佈，但在中國的一些城市，工商管理部門已經開始接受了唯冠公司的投訴，採取行動收繳iPad。這些行動使得各地的蘋果產品經銷商都不得不將iPad下架。
