First, I need to explain these two terms as legal documents. So I will treat them as a noun. Later, we are going to see them used as other parts of speech. Just so you know, a legal document can be used in court as evidence.

Lease和Rent的用法區別

首先,這兩個術語可以解釋爲法律文件,所以可當作名詞。其次,也可看到這兩個詞的其他詞性。正如你所知道的,法律文件可以作爲證據在法庭上使用。

For purposes of making this easier to understand lease will be referred to as Lease Agreement. The word rent will be referred to as Rental Agreement.

爲了使這一點更容易理解,lease將被稱爲Lease Agreement,rent將被認爲Rental Agreement。

A Lease Agreement is a legal document between the person who owns property (landlord or car dealership or Lessor) and the person who wants to use the property (tenant or Lessee) stating how much payments are and how long they will be paid.

Lease Agreement是指在擁有物產人(房東或汽車經銷商或出租人)和想要使用該物產的人(房客或承租人)之間的法律文書,用以說明支付數額以及付清時間。

You can think of a lease agreement as a long-term plan that does not need to be re-written every month. Lease agreements can be written for a period of six months or one year or more.

lease agreement可以看成是一個長期計劃,不需要每個月都寫一遍。lease agreement有效期可爲六個月或一年以上。

Both parties (people involved in the transaction) agree upon how much will be paid as well as other responsibilities. The lease agreement is signed by both parties and will be valid until the end of the period mentioned in the agreement.

雙方(參與交易的人)同意支付多少款項以及其他責任。lease agreement由雙方簽字,協議有效期至協議所述期間結束

Again, it is like saying I will let you stay in this apartment if you pay $100 per month, every month for 2 years. So you have to stay in the apartment for 2 years. If you want to move out, then you might have to pay a fine (penalty in money).

同樣,這就像是說,如果你每月支付100美元房租,爲期兩年,你就必須在這個公寓裏呆兩年。如果想搬出去,就得付罰金。

What happens after 2 years?

那麼,兩年後呢?

Either you re-new the lease agreement or you can move to a different home without paying a penalty in money.

要麼你再續lease agreement,否則就要搬到一個不同的地方,但無需支付罰款。

After two years, the landlord, lesser, or person who actually owns the property can change the amount needed to be paid or lease the property to someone else.

兩年後,房東、出租人或實際擁有該物產的人可以改變所需支付數額或將財產出租給其他人。

Now let’s look at Rental Agreement.

現在我們看看Rental Agreement。

A rental agreement is almost identical to a lease agreement except in terms of duration.

rental agreement與lease agreement除了在時效期上有區別機會相同。

A rental agreement is not a long-term contract. A rental agreement only lasts 30 days to one month and then is renewed after each month.

rental agreement並不是一個長期合同,只持續30天到一個月,然後每月更新一次。

What does this mean?

這是什麼意思?

This means that both parties can change the terms of the agreement at the end of each month.

這意味着雙方可以在每個月底改變協議的條款。

The person paying money the property (tenant) may move out without penalty or the person receiving money for the property (landlord) can tell the tenant to move out for someone else to move into the apartment.

支付租金(房客)的人可以不受懲罰地遷出,或者收取租金(房東)的人可以告訴房客搬出,這樣其他人好搬進公寓。

What are the benefits in having a lease agreement?

擁有lease agreement有什麼好處呢?

If you are the person paying money for the car or the property, then the lease agreement protects you from changes being made from month to month.

如果你是汽車或該物產的購買者,那麼lease agreement會保護你的利益不受每月一次協議變更帶來的影響。

For example, the landlord could INCREASE the amount to be paid. The amount to be paid could be $100 for January and then in February it could be $125. This still could be changed in March to $150 if you only have a RENTAL AGREEMENT.

例如,房東可以增加房租支付的金額。1月的房租支付金額可能爲100美元,而2月則爲125美元。如果你只有RENTAL AGREEMENT,3月份的房租就可以改爲150美元。

In a lease agreement the amount cannot be changed or altered until the end of the lease. This could be after 1 or 2 years. So for 2 years you could be paying the same amount and not have to worry if the price was going to change every month.

在 lease agreement中,租賃期結束之前,支付金額不能更改。這可能是1年或2年之後。因此在2年內你可以付同樣的錢,而不用擔心每個月的價格是否會改變。

Let’s go back to the terms lease and rent.

現在重新回到術語“lease”和“rent”

Lease = Lease Agreement

Rent = Rental Agreement

I want to focus on the parts of speech for each of these words.

我們將重點放在對於詞性的分析。

Starting with Lease it can be a noun. When it is a noun, then we are referring to a legal document (an object or thing). This is the paper document that can be used in court if there is a problem.

從Lease開始講解,該詞可以是名詞。當它是名詞時,我們指的是法律文件(一個物體或事物)。如果存在問題,這些則是可以在法庭上使用的文件。

Here are some examples:

下面是一些例子:

I need to review the lease before I sign it.

在籤租約之前,我需要複查一下租約。

The lease needs to be renewed next month.

租約下月需要續租。

I have a ten-year lease on the car.

我有一個十年租賃協議的汽車

This word “lease” used as a noun, can also mean the property that is leased.

 “lease”一詞用作名詞,也可以指出租的財產。

For example:

比如

I need to go check on the lease to make sure it is in good condition.

我需要去檢查一下租約,以確定毫無問題。

Lease can also be used as a verb. In this case we are NOT talking about the paper document. We are talking about the action of allowing someone to use your apartment or car in exchange for money.

Lease也可以用作動詞。在這種情況下,我們不是在談論紙質文件。我們談論的是允許某人使用你的公寓或汽車來換取金錢的行爲。

For example,

比如

He wants to lease his house to a family member.

他想把他的房子租給一個家庭成員。

The lawyer advised the new property owner to lease her apartments to people with children.

律師建議新房主把她的公寓出租給有孩子的人。

The word rent when used as a noun refers to the payment that is made during a period (usually every month) in exchange for land or property.

當用作名詞時,指的是一段期間(通常是每個月)內使用土地或財產的付款。

For example,

比如,

I need to pay the rent by the 15th every month.

我需要每月15號前付租金。

When is the rent due?

租約什麼時候到期?

What is the rent? It is $500 per month.

租金是多少?每月500美元。

When the word rent is used as a verb it means to allow someone to use something of yours (like a car or an apartment).

當“rent”這個詞用作動詞時,意思是允許某人使用你的東西(比如汽車或公寓)。

For example,

比如,

I have an apartment in New York City that I rent to a nice family.

我在紐約有一套公寓,租給了一個和善的家庭。

I am thinking of renting my car to make some extra money.

我在考慮租賃汽車賺些外快。

Are you renting this apartment?

你租這間公寓嗎?

Of course how often the document needs to be reviewed will determine if it is called a lease or rent.

當然,該文件需要多長時間審查一次,將決定它是 lease還是rent。
